FAQ

What is life insurance?

Life insurance is regarded as financial protection against losses that are incurred due to a loved one’s death.  When a person has a life insurance policy, and he/she passes on, the beneficiaries listed on his/her policy will receive payment from the person’s life insurance company.

What is a life insurance policy?

A life insurance policy is a legally binding contract between a policy holder and an insurance company.  The contract specifies that in the unfortunate event of the policy holder’s death, the insurance company will pay a set amount of money to the policy holder’s beneficiaries.

What is material misrepresentation?

Material representation is the purposeful concealment of a relevant fact.

Can a person be denied payment of a life insurance claim due to material misrepresentation?

Yes, a person can be denied payment of a life insurance claim due to material misrepresentation.  For example, if a person took out a life insurance policy and concealed or fabricated a fact (such as tobacco or drug usage), his/her life insurance policy may be regarded as invalid in the unfortunate event of his/her death due to his/her misrepresentation.

What is a “bad faith claim”?

A bad faith claim is when an insurance company does not uphold its’ contractual duty by failing to pay legitimate claims.

Should I accept a settlement form the insurance company?

No, you should not accept a settlement from an insurance company.  If you are offered a settlement, you should seek legal counsel before even thinking about accepting payment.   Insurance companies are looking to save money and will usually try to settle for a minimal amount.  If the insurance company offers you a settlement, contact an experienced attorney like the attorneys at Zealous Legal Advocates before accepting anything.

Can a life insurance company legitimately delay or deny my claim?

No, but they will do everything to delay your claim until you are frustrated and go away, or they will deny your claim, if they think they have a more legitimate reason for denial.  Our law firm will get the insurance company to pay your claim.

How long does my life insurance company have to pay me my claim?

The insurance company is supposed to pay you in a reasonable amount of time.  This should not be more than 5-6 weeks.  If they have not paid you during this time frame, then they have acted in bad faith.

If another person is claiming to be the beneficiary of the policy which is supposed to go to me, what should I do?

Contact us, and we will get the insurance company to pay you the money that you are entitled to.

I have an Accidental Death policy, and my claim has been denied.  What should I do?

Our law firm will recover the money that you are due.  The insurance company may have said that the deceased had alcohol in his or her bloodstream, thus denying your money.  Our law firm has experts which will show that this alcohol was not sufficient to void the policy.
